They are trying to fire her---Why? Today's Division of Real Estate article

Suspended real estate regulator Erin Toll today filed a whistleblower complaint against her boss with the State Personnel Board that shows she was involuntarily placed on administrative leave last week and that there is an investigation into her conduct underway.

Toll and her lawyer Bill Finger, a specialist in public employment cases, say Toll was engaged in a protected activity when she said state Sen. Ted Harvey may have a conflict concerning proposed legislation affecting how mortgage brokers are regulated.

Toll alleges in the complaint that Department of Regulatory Agencies Executive Director Barbara Kelley usurped Toll’s power when she later stated that Harvey was not under investigation and when Kelley ended the probe into his employer, American Home Funding.

This raises some interesting questions

Most important

1. Why was the investigation into the conduct of American Home Funding ended?  Was it because of political pressure?

2. Does the director of DORA have the authority to end the regulatory actions by heads of individual regulatory agencies.

3. Why was Erin Toll placed on administrative leave?

Question #3 will only be answered through litigation, but question #2 is a policy/procedure question and Question number #1 should be answerable with a CORA request.

Inquiring minds want to know.
