I’m late getting to this, but The Denver Post made the wrong decision Thursday in covering a Court of Appeals decision in favor of conservatives on the Douglas County School Board–while ignoring a Court of Appeals decision against former GOP Secretary of State Scott Gessler on the same day.
The Gessler decision, which was unanimous, affirmed that one of the state’s highest elected officials used his position (and our money) for personal and political gain. That’s about as serious a ruling as you get in our representative government.
In a split decision with a stinging dissent, the Court of Appeals also ruled that the Douglas Country School Board did not violate Colorado election law by emailing a report, favoring conservative education policies, to 85,000 subscribers prior to the November election.
I don’t see The Post’s logic in prioritizing a not-guilty verdict in a school board matter over a serious decision against Colorado’s Secretary of State. You can argue that both deserved coverage, but if you pick one, Gessler wins (for once).

While I am hardly one to praise the ever anemic coverage of local politics by the Denver Post (both stories were clearly newsworthy), the fact that the Gessler decision is affirming a lower decision and hence not changing the status quo, and the fact that Gessler no longer holds elective office, make that decision far less breaking news.
The Gessler decision might be better to cover as part of a retrospective article on Colorado political scandal in this coming Sunday's paper since it was not covered as news at the time.
The Independent was the only media outlet that covered the Gessler decision. Part of the problem is the IEC has now decided that it will not publicize its opinions or significant cases. If you are interested, you have to go to their website and look for them. (Although the Gessler decision is absent from there). This should have been widely distributed. Gasser and his attorneys repeatedly attacked the integrity of members of the Commission and others, and the Court is scathing in its description of Gessler's arguments.
Pretty sure they could have managed to cover both. Pathetic.
Even a small story would have been better than nothing. If you google "Scott Gessler", nothing about the Court's decision comes up. Pathetic is the right word.
