A Denver judge Wednesday cited anti-tax activist Douglas Bruce for contempt of court, finding there was cause to believe the former lawmaker “has obstructed the administration of justice.”
Bruce, who did not return telephone calls or e-mails seeking comment, has called the court proceedings against him a “lynching” in e-mails to Attorney General John Suthers’ office.
The attorney general’s office sought the contempt-of-court citation, granted by Denver District Judge Brian Whitney, after Bruce failed to testify in a campaign-finance case launched to find out who funded three tax-slashing and government-limiting initiatives that are on the November ballot.
The state tried 30 times in May to serve Bruce with court papers ordering him to testify in the case. An administrative law judge subsequently ruled there was sufficient evidence to show Bruce was an organizer of the initiatives effort.
Whitney’s ruling orders Bruce to appear in court July 26 to explain why he should not be held in contempt of court. Suthers’ office argues Bruce should be fined for the costs of attempting to serve him.
In his order, Whitney said Bruce “remains in disobedience” of prior court orders and appears to have “obstructed the administration of justice.”
The state now must serve Bruce with the court order holding him in contempt. Mike Saccone, a spokesman for Suthers, said that after a Friday e-mail from Bruce, the attorney general’s office is optimistic that would not be a problem.
“Based on that e-mail, we have every reason to believe Mr. Bruce is willing to comply with the process,” Saccone said.
Bruce’s e-mail had a defiant tone, and in it he said the contempt-of-court action would benefit Suthers’ re-election efforts.
“Using an unpopular public figure as a political whipping boy has got to be a political ‘no-brainer,’ a slam dunk winner,” Bruce wrote.
But he also said it would not be necessary to haul him before the court.
“If you obtain a warrant for my arrest, I am notifying you that I will appear voluntarily in court at any time,” Bruce wrote in the e-mail. “There is no need for a ‘perp walk’ parading me in handcuffs, or to allow your friends in the media to take pictures of me in an orange jump suit. I have done nothing wrong, as you will soon find out to your deep and very public embarrassment.”
I for one would like to see Bruce do the perp walk complete with orange jumpsuit and leg chains.

If Mr Bruce is so cooperative, why doesn’t he agree to accept service by registered mail?
I’ve done it before in civil actions- I presume Colorado allows it.
