Obama Cannot Extend His Term By Declaring Martial Law. I can't believe I have to explain this, but so many people are talking about it, so here goes.
Obama has almost completed two terms. He is constitutionally ineligible to serve a third. See Amendment XXII. This is a flat bar. Any attempt by Obama to serve any portion of a third term is simply void.
Similarly, Obama's term ends in January of 2017. See Article II, Section 1. Any acts taken by Obama outside of this term are the same as actions taken by you or I. In other words, actions carrying no legal force of the office of the Presidency.
Finally, Obama cannot get around these rules by declaring martial law. It is noteworthy that people who claim this never cite to the portion of the Uniform Code of Military Justice they think would allow such an action. Even if such a section existed (and I am pretty confident it does not), it would have no legal effect as the Constitutional provisions I listed above would absolutely trump it. See Article VI, Section 2, declaring the Constitution as the Supreme law of the land.
