At Least It's Not Your Terrorist Registration Act

  • by: Colorado Pols

Raw Story reports from South Carolina:

Terrorists who want to overthrow the United States government must now register with South Carolina’s Secretary of State and declare their intentions — or face a $25,000 fine and up to 10 years in prison.

The state’s “Subversive Activities Registration Act,” passed last year and now officially on the books, states that “every member of a subversive organization, or an organization subject to foreign control, every foreign agent and every person who advocates, teaches, advises or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States … shall register with the Secretary of State.”

There’s even a $5 filing fee.

By “subversive organization,” the law means “every corporation, society, association, camp, group, bund, political party, assembly, body or organization, composed of two or more persons, which directly or indirectly advocates, advises, teaches or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States [or] of this State.”

Just extra penalties that can be assessed should anyone commit related already-illegal acts, so don’t get overly “police state” about it, but the humor potential is self-evident. That said, if we hear Sarah Palin talking about “terrorism permits” and not kidding, we take all the jokes back.

  1. and Rick Perry and Todd Palin a lot of money.  Any word yet on how many permits the Klan and teabaggers have applied for?

“The U.S. economy will bottom in the next two years. It will need 15 to 17 years to recover fully, if past recessions and depressions can be used as guides.”  -Scott McInnis

“Three or four years from now, we’re not going to have a conversation about jobs and all of that kind of stuff.”  -Scott McInnis

  2. .

Isn’t the central purpose of the Democratic National Party to gain control of, or at the very minimum at least conduct, the Government ?

Isn’t that the raison d’etre of the GOP ?

Certainly the Constitution Party directly advocates seizing control of the federal Government through the ballot box.  I know I do.

But doesn’t the Constitution throw up some kind of barrier [implicit in Article 4 ?] to one State (South Carolina) reaching into and meddling with a citizen of another State (Colorado ?)

    .

    1. …doesn’t some of the language of the SC law strike you as a tiny bit unconstitutional?

Sounds like silly season down south to me. Must be all that snow on the East Coast.

      1. .

who is going to characterize themselves as being in violation of a “Terrorist Registration Act” in order to challenge its constitutionality ?

I can just imagine the problems this presents for crowd control:

“Easy, now.  Form one single line.  Those who have actual plans to destroy government institutions, and enough explosives to get the job done, you can jump to the head of the line.

“Those that are mere conspirators, step to the rear.

“If you’re just a voter who wants to ‘take back your country,’ please come back next week.”

        .

        1. White separatists?

          Secessionists? (in Texas or Alaska)

If so I think there are many groups that have an ideology advocating the dissolution of the union or its overthrow.

Americans are free to believe in idiotic and odious ideas and associate with other like minded people.  What you are not free to do is act on those beliefs if those actions violate laws designed not to regulate the ideology, but the conduct.

          Ridiculous law.

          1. It must still exist as some shell of an organization. Once SC comes down on them, we’ll see this law fall under the first whiff of judicial review.

SC won’t go after white separatists and secessionists. Too much like biting the hand…
