According to the Associated Press, Republican Marc Holtzman has won his court fight and will make the primary ballot.?Bob Beauprez’s campaign is set to challenge a different set of signatures, however, so this isn’t over yet.

  1. I read that Norton argued Beauprez would have to spend money if Marc’s name is on the ballot. Well, YA.  What does BB think? He gets a free walk into the mansion?  But seriously, I’m fine with a primary. And I don’t buy into this “unity” crap.  So long as folks come together after the August vote and into the November vote, republicans will be fine.  We’ve gotten through hundreds of years as a party with primaries and I doubt Mark Holtzman single handedly has the power to divide us now.

    This is between the sec of state and Marc Holtzman, for them to come in and flex their muscles one more time just proves how desperate they are to keep Marc off the ballot. Do you even care what the voters think Bob Beauprez? Do you even want to have elections anymore?

    A BB democracy: Leaders are chosen through sueoff’s. Whoever has the best lawyer wins, screw what the coters think.

  5. Hell, this is nothin that a well placed lawsuit can’t fix. Johnny Boy, call our lawyer. We will sue all 21,000 voters who signed that damn petition just for signin. We will sue Marc for even tryin to run and then we will sue anyone else who gets in our way to world domination. By the time I am done it will be a crime to even mention the word Holtzman.

Mike Norton represents some “disinterested individual Republicans” who are challenging some signatures that Marky Boy submitted and which GiGi actually found to be valid.  I’m amazed at Norton’s arguments that there should be no primary bec. it will cost “Both Ways” money (like that’s really much of a problem) and cause disunity in the GOP.  Those are nice political arguments to make at the state assembly to discourage a primary.  Those are not legal arguments to raise in a case on ballot access.

  8. I heard Beauprez, the state party, the secretary of state, Trailhead, and the others trying to get in on this lawsuit brought dozens of lawyers, and Grueskin and Head–two guys–obliterated them. Hilarious.

    People rooting for MH – why?  Do you really think he’s an underdog?  The state assembly doesn’t want him on the ballot and he failed to get signatures (this is a fact in the 1st district).  HE FAILED TO MAKE IT ON THE BALLOT.  That’s not an underdog, that’s failure.  That means the end of the road.  There’s nothing to root for when someone takes it to the courts.  I could file a lawsuit against God charging that he made ants unfairly unable to protect themselves from being squashed and get 3 of 10 judges to hear me out.  So really, why root for this guy? 

    I’m sick for this state, and for this country in general.  MH’s ‘scorched earth policy’ (his campaign manager’s words in the Rocky) is abhorrent. 

    The worst part about this is that he can’t possibly win this primary.  All he’s doing is weakening the party – and not for the greater good either.  Marc – all the elections, positions and power in the world aren’t going to fix what’s really wrong with you. 

    But hey, you have to live with you.  And in that case, you’ve got it worse than anyone.  Thanks for sharing your sickness with all of us.

  15. Wondering abut a couple of things: under what basis did the judge rule MH on ballot if he can’t check sign himself and clearly did not have time to do it. Does this mean anybody can get on a ballot, that collection of sig aren’t necessary anymore? Can this ruling be appealed to a higher court by the GOP,  or another entity? Was the judge a DEM who has an interest in keeping MH on ballot?  even the newspapers said he didn’t have enought sigs even if those in doubt were let in. Also does this mean sos never has discretion over who gets on ballot? You can bet the legislative rules won’t be rewritten with a dem legislature. They just get to select dem judges which most are and get the results that are good for them.
    Haven’t posted befoe just  a lurker. orgianlly had nothing MH but frankly he is ensuring a dem victory due to his attack ads which do hurt BB but do not help him just Ritter and to his bizarre behavior.

    Imagine the oddity of the courtroom scene…. a far left liberal attorney representing a guy who is in the 11th hour of his political life…a guy who claims to be a staunch conservative.

    Just months ago, MH wouldn’t have been caught in the same room as Grueskin, and now here’s Grueskin filing lawsuits on behalf of MH.

    Because they’re Democrats.  These are the same loons who for weeks were crowing that Hickenlooper was going to be their anointed one, that Ritter would be forced out long before a primary.  They had Ritter (who’d already been campaigning for months by that time) running for AG… as though that were Ritter’s consolation prize.  Then, when Hick decided to stay put as Mayor, they were lost among their own.  They’re trying to put on a game face of it, but they just don’t like their own candidate.  So now, in order to weaken the GOP’s chances of winning, they NEED this long, drawn out primary battle.  It gives their candidate hope, even though they know that their candidate is 2nd fiddle.

    Check out the meaning of the word “schadenfreude”.  It fits the liberals feelings to a “T”.

    I don’t know about Judge Mullins’ political leanings, but he was appointed by Roy Romer in 1990.

    And not to worry… if this happens to the Dems at any time, you can be sure they’ll want the rules changed immediately and retroactively, re: the SoS decisions.

Met him, listened to him speak, Hated him!  Heard him speak over the weekend in Keystone.  Out of touch for what local government needs in this State.  Struggling to find a voice, totally off base on transportation and other issues.  Had to keep glancing at his blackberry to get notes from the guy in the back furiously typing.

    Bottom line, I’m glad he’s still around.  He represents a population of this state and it is important that they are heard.  I don’t like the guy, won’t vote for him, but this is the way things work in the system.

    MH hired the best he could get.  Your right, there was a political motive behind this, since Zakhem’s firm, the paid representive for the GOP and Trailhead, would not represent Holtzman when he needed them most. 

    The Colorado Republican Party, Beauprez, Dennis, Owens, et al, have failed.

  24. much like you hate holtzman, there are an equal number of people who hate beauprez. beauprez has no appeal to people outside of the caucus attendees and activists. he essentially went to a gathering of his closest friends to find out 28% (or whatever the number was) don’t like. as a two term congressman, holtzman shouldn’t have even got that many votes.

    look beauprez is going to have to answer some tough questions about his spending and immigration.

By the way, do not tell Democrats who they like, or do not like.  It doesn’t work like that.  We looked at all possibilities, including Udall, Lindstrom, Salazar and Madden.  All of those Dems had leaders and grassroots asking them to take a run for the “open seat.” An open seat is very desirable, especially the Governors. They all looked and decided to back Ritter instead. 

    We have our candidate.  Bill Ritter is taking this one in November, no doubt about it. He has the party, the base, the moderates and even Republicans backing him.  It’s not just about “unity,” but rather the better man for the job.  It’s obvious the two on the right do not measure up.

    Sorry Remarkable, our choice IS Bill Ritter and there is nothing that is going to change that.

  28. As of May 25th, %40 of Coloradans hate Bob Beauprez. It’s hard to imagine, with him being a dair farmer and Republican insider and all but it’s true. Bob’s arrogant despicable disenfranchising behavior over the last few weeks have probably raised that up to around %55.

    Both Ways Bob better hope that Holtzman doesn’t make the ballot.

    And indeed, there are many D’s we’d like besides Ritter. That said, Colorado needs a simple change — to government that functions, and doesn’t run our economy into the ground.

    Most of all, folks such as Udall and Madden are great, but this is still a purple state. The races in 2000 – for both Salazar – brothers proved the a big point.

    Right wing R nut vs a moderate Dem = Dem win

    Run a normal conservative against a left Dem – then it is a fair fight.

    With a left Assembly and Senate, they can cover their asses at home with no problem, get great bills to Ritter. Ritter can then mea culpa, and build up for the race in 4 years.

  38. Just got back from an LPR function tonight. This was the scuttlebutt all night, and BB people are worried about money in a primary.  But certainly they knew from the beginning there would be a primary fight? Since when did MH leave any shadow of a doubt he was fighting to the end? 

    Also, I guess the Susan Greene piece on BB comes out this weekend. They aren’t expecting it to be good.

Did I call this one or what?  I said that the judge would determine that there was enough reason to question the process.  So, since Gigi and he folks can’t seem to figure it out, the judge called the shots.  Romer appointee or not.  The judge basically slit the baby, that is usually the moderate approach.

    Holtzman gets on the ballot, and Gigi has to prove that he isn’t qualified ot be there.  Come on, when the Holtzman people are able to located petition signor by calling phone numbers, what is up with that?

    Not to mention the legitimately registered Republicans that were not included.  The judge saw that there were irregularities in the process.  The only people that haven’t figured this out is the folks in Beauprezville with their rose colored glasses.

    As for the law suits.  Wasn’t it Durham who went to court first?  Oh, that’s right.  You Beauprezville folks suffer from “Old Timers” disease.  You forget things by the minute.  Forget BB’s lame voting record in Congress, you can’t seem to remember from one day to the next.

    The whole process, orchestrated by Benson, Owens, Beauprez, Dennis, Durham, Schuck, and the list goes on and on.  The Elephant Parade at state GOP has shown its true colors.  We want people to run, only we want those whom we choose, when we choose, and such.  Taminy Hall (Colorado Style).

    When those Conservatives Wanna Be’s who are supporting Beauprez realize that they have been lied to by the Beauprez cronies, they too may develope a conscience.  Then again, maybe not.

    Why is it that Beauprez hasn’t named a running mate?  Wasn’t the purpose of changing the law so that a team could be put together earlier?  Who pushed for the change?  Billie (B.O.) Owens?  Isn’t it just amazing how the Repub establishment boyz change the rules as the game goes along?  Time for a change and this is just the beginning.

  46. Let’s just be clear: it has not been established MH didn’t have the signatures. The Secretary of State found insufficiencies. But the judge must have found a preponderance of evidence showing he may very well have those signatures. Otherwise, he would have dismissed the case altogether.  Root for whomever you want, but at least get the legal facts straight.

    Well, it looks like Im strapped down for a few more weeks. God I hate grueskin so much. Today was pretty much like any other day. Me and Marc finally christened the old campaign bus, but it was probably the most boring 15 seconds of my life. Then Marc found yet ANOTHER democrat that wanted him on the ballot, so he kind of just stopped talking to me so he could go practice that lady-killing smile of his. Im so proud of him! Then I called my good friend Katie Holmes to ask for advice on how to keep doing this with a straight face…She told me to get knocked up so that anything irrational that I do can just be attributed to hormones. lol.     I was in the front row, there was no Blackberry to be seen there buddy. I did not agree with everything he said but there sure was no Blackberry.

    I was also very dissapointed that Bob Beauprez was not there. I voted for him at the assembly, but now he sends Jim Sullivan to talk to our group. Furthermore, we know he missed a crucial vote for his district during the same time period. Obviously there are a lot of staffers here from both sides, someone please explain to me why Bob Beauprez expects our support but them acts like this?

  49. The judge did not make a ruling based on evidence, mr GOPer. Its my understanding that the judge simply put him on the ballot because if there were enough signatures found later, it would cause “irreparable harm” to Holtzmans Crusade if GiGi didnt ceritfy the ballot with him on it today.
    The 9news artice is only a few paragraphs long, I suggest you read the whole article before trying to prove one of the Marc Interns wrong.

    What we do know, is that the bulk of the rejected signatures, according to RMN were from voters who werent registered republicans. I know its hard to comprehend, but its actually very black and white. IF YOU ARENT A REGISTERED REPUBLICAN, YOUR SIGNATURE DOESNT COUNT. you can get 100,000 democrats to sign your petition, but if there arent 1,500 republicans, YOU DONT HAVE ENOUGH.

  54. I have to say I strongly dislike the concept of a name being on the ballot if votes for that name won’t count. And that is the way this is headed now. Judge Mullins ordered the SoS to add Holtzman to the certified ballot, but when it is confirmed that Holtzman does not have enough signatures, any votes he gets will not count.

    If the News reports are correct about Holtzman’s legal argument, he really does not stand a chance. They are arguing that since provisional ballots are accepted from anywhere in the state then Holtzman should not have to be held to distirct requirements. The problem with this argument is that provisional ballots are not accepted from anywhere in the state. If you live in one county and vote provisionally in another county, your vote for statewide offices MIGHT get counted if the ballots reach your home county in time. But there is no legal requirement for the county you voted in to get them there in time.

    And even if your provisional ballot is accepted, the only votes that count are the ones for offices or ballot questions you were entitled to vote on in your home precinct. So if you cast a provisional ballot outside of your congressional district, the ballot you are using will show the congressional candidates for where you are, not where you live. Therefore your vote for Congressmembers will not be counted.

    This same principle, once applied to the Holtzman argument, actually goes against Holtzman’s attempt to get his votes counted.

Sorry Dan.  Think you are wrong on this one my friend.  The purpose of a provisional ballot was in the case of where a person was registered as a republican and could vote but whose name did not make it on the voter rigistration lists with the Clerk & Recorder.  If your argument is true, then why have absentee ballots and provisional voting at all?

    Absentee ballots are counted if the person voter prior to the deadline and the U.S. mail failed to get the ballots to the Clerk & Recorder in time.  Remember Florida.  Wasn’t G.W. waiting for the absentee ballots from the military???

Sorry Luci.  there you folks go again, spouting off trash talk like before the caucuses, the state assembly, and the saga continues.  The 4230 signatures were thron out because the circulators names did not appear on the SoS’s rolls.  Didn’t mean that they weren’t registered Republicans in other counties.

    For example, if a circulator registers in Baca County, do you think that Baca County sends that data immediately to the Sos’ office?  NOT.  Geese, you folks just never quit.  As for the SoS’ not allowing Holtzman to appeal, it was Holtzman who declined based upon the flawed process.

    For whatever reason, the judge at least felt that there was enough evidentiary information to go forward.  Seems the judge wasn’t much interested in hearing from Mikie Norton and his cadre of “undisclosed Republicans” and Bob Martinez.  What was their evidence again? 

    Oh, I know.  How the Bb people would have to work hard.  How they would have to spend money.  How it would split the party. All Bull.  Then again, wasn’t BB’s original campaign strategist a guy by the name of Full R. Bull?

      And why in California?  He’s running for Guv of Colo.  He could turn a big Colo. wedding into a media event, and the reception into a campaign fundraiser. 
      Perhaps he’s suffering from a Ross Perot Syndrome……fear that various establishments Republicans (in Ross’ case, it was Daddy Bush, et al.) were allegedly going to sabotage Ross’ daughter’s wedding.  Is the Little Fella worried that Head Trail will do the same if he gets married in Colo.

    cherney is bad character and the fact the beauprez was flown out there to the tune of $21,000 that he waited until the heat came down to report speaks worlds about his character.  cherney is thought to be involved in money laundering and murder by the u.s., western european countries, and the fbi.

  69. Marc Holtzman is challenging the petition signatures that the SoS threw out.  Bob Beauprez is challenging the validity of the petition signatures that were approved by the SoS.  These are Republicans criticizing the SoS, a member of their own party. 

    If the petition process has raised this many questions/concerns, can Colorado voters have any reliability or confidence in the SoS’ ability to effectively handle the Colorado Primary and the November election?  No Way!!!

Judge the candidates by the company they keep, their voting records, and their positions on the current issues.  Bob’s record on immigration reform is weak and he didn’t vote to do anything until he cut a deal with Tancredo in return for his support.  Quid pro quo is not a value I cherish in our Republican (non)leaders.  Support Ritter instead?  Will Bill Ritter put forth solutions for illegal immigration besides amnesty?  Unlikely.  Did he support C and D and higher taxes?  Of course!  I’ll vote for Holtzman unless he gives me reason not to.  He’s the only one with the brains and stones in this race to lead.  Start the debate on the issues, please!

  78. Ya I knew but I always wrote it off to Mike’s issues with his father and the fact that he got married too young. I never met her but Mike never talked bad about her so I just considered it one of those things that happens in life. But then to hear him lying about Marc and Kirsten just threw me over the top. I don’t understand why him and Hillman feel the need to run this wierd group campaign with Beauprez. Mike hates Hillman and considers him to be a lackluster farmer who got lucky in a primary. I always thought Hillman was decent for a no college kind of person and he’s done well considering but why can’t they understand they have no place getting involved in the races of other people?

    You are right about the provisional ballot being used by mail-vote voters whose ballot did not get there or who should be on the rolls but are not. However, under new legislation passed in 2005, provisional voters may cast ballots outside of their own precincts, but the only races that will be counted will be races (or questions) that were on the provisional ballot they used that they would have been qualified to vote for if they had voted in their home precinct.
    Therefore if a Jeffco voter from CD7 votes at a polling place down in CD6, he will have to use a provisional ballot and his vote will not count for the congressional race because he is voting “out of district”.
    The new “vote center” concept allieviates some of this problem, because then you can vote at any voter center in your county and have all your votes counted even if you have to use a provisional for some reason (mail ballot issue or voter rolls issue).

  89. The law now says that someone can vote provisionally in any part of the state and have their vote counted for statewide races as long as they were indeed properly registered somewhere in Colorado.

    This is the basis of the Holtzman argument concerning his petitions. However, for the petition, the law also has a provision that 1500 signatures must come from each of the congressional districts.

    It is a stretch to say the provisional ballot law overrides the petition requirement as the two are not related. Ballot acess and voting procedure are far enough apart legally that I don;t think their argument will hold water.

    I gave a different argument is a pretty long post upthread quite a ways. (It’s approx in the middle of the current number of posts)

  90. Dan.  The point most of the people are forgetting is this.  Holtzman was short signatures in two districts. A total of 733 respectively at the present time.  That is with the 4230 signatures (not included).  It is the campaign’s contention that these signatures were never reviewed (individually) merely because the petition carriers names did not appear on the SoS’ registration files.

    If Holtzman can prove that these individuals registered as Republicans in order to carry the petitions anywhere in the state of Colorado.  Even if it were on the same day.  Simply because their names don not appear on the SoS’ roles in no way invalidates the signatures of the individuals.

    Will there be signatures that are considered invalid, yes.  Will there be signatures that should be included, yes.  It is the contention of the Holtzman camp that they meet the 1500 required in both Congressional Districts if they are allowed to add the 4230.  These individual signatures were never reviewed individually at all.  This is the point that people are missing. In addition, the Holtzman camp will still be given the opportunity (under Colorado law) to rehabilitate any signatures ruled invalid by the SoS’ office.  This has not occurred.

    In the past, even if there were incomplete signatures, signatures were signed the same day as the petitions were notarized, etc. the courts have looked at the intent of the carriers and the signors.  Case in point is the Stanke and Mark Cloer race in El Paso County two years ago.  Even Linda Stanke testified that she filled in much of the information on the petitions, she wasn’t the carrier or the notary and the courts allowed the primary to go on.  How do you explain this?

    The arguments by Norton and his tribe of “unkown Republicans” is specious at best.  To attempt to have more than 10,000 signatures thrown out will not hold water.  He knows it, and the rest of the world knows it.  Even if 10,000 signatures were ruled invalid, Holtzman still has me the 10,500 threshold. 

    The problem here is that neither the Norton, nor the BB folks get to pick and choose which are accepted and which are rejected.  A standard is established, the rules applied and whatever happens, happens.  To attempt to pick and choose would invalidate the entire political petition process.

    The fact that there were registered Republicans, in numerous counties, who have been registered Republicans for years, many who are party activists and were thron out raises some serious questions about the process. 

    For example:

    How do you explain that a person’s signature is thron out when their spouse signed the same petition?  This occurred.  How do you explain that a 60 year Republican’s signature is thrown out when it appears on the same exact petition as Lola Spradley?

    Flawed is as flawed does.  The spotlite is on the SoS’ office.  They got caught with their pants down attempting to do BB a favor, pure and simple.  The only way for the BB Camp to save face is for Norton and Company to get their way.  by eliminating countles thousands of signatures, there is no manner in which Holtzman could appeal.  Doubt very seriously that will happen.

    Just so happens I carried two of the petitions in which names were excluded.  I have been involved in El Paso County Republican politics for over 25 years.  I had the petitions notarized at a local branch of ENT Federal Credit Union.  Do you honestly believe that I didn’t know who was signing my petitions?

    When I heared that a local Colorado Springs City Councilman’s signature was thron out, and his wife signed the same exact petition!!! Give me a break!!!  Something smells very wrong here.

    I honestly don’t believe that it was at all intentional, simply because the parties involved “WERE TOO STUPID FOR THAT.”

    JUST A NOTE:
    It is believed that the Norton people are attempting to have the 10,000+ signatures ruled invalid because one of the notaries who signed the petitions for the Holtzman Camp is also a supporter.  Where in Colorado law does it say that the notary must be an independent third party?  Nowhere.  Sounds a little like someone is attempting to reinvent the wheel here.

  96. According an article in the Denver Post last week, even if Holtzman were allowed to count all 4230 signatures he would still be short in CDs 1 & 7 because there are simply not enough signatures from those district to make up the current shortfall.
