CD-2: War of the legal complaints

Ok, Will charged Jared with incomplete donor filings. Jared raised Will with fradulent donor filings. Now Will raises Jared with stealing their donor list and violating the CANSPAM act.

It has come to our attention that you may be receiving unsolicited emails from the Jared Polis campaign. We believe their campaign may have illegally obtained our donor email list. While we continue to investigate we urge you to call the Polis campaign at (303) 381-0121 and ask to be removed from their list and also ask how they obtained your email address in the first place. You can also follow this link to file a complaint with the FTC if you would like to do so https://rn.ftc.gov/pls/dod

At the Shafroth campaign we have a policy of not selling or giving away your personal information and we are taking this breach very seriously. Please feel free to call me on my cell phone with any questions (303)579-8794.

Pretty clearly Jared pounded Will back hard to try and end Will taking this approach. And now pretty clearly Will is taking that not as a warning but as a challange and is firing back with a pretty serious claim.

I don’t think anyone predicted this – Joan keeps her head down and Jared and Will fire at each other. Joan’s gotta be having a good day.

Anyone out there that is on Will’s email list but not Jared’s? If so, did you recently start getting emails from Jared’s campaign? (I’m on all 3 so I would not know.)

If this did happen, this will be very bad for Jared. If this did not happen, it’s very hard to prove a negative. So not good for Jared.

ps – Will sends a link for complaints – and it’s the U.S. Army’s link to the FTC. Any idea why?

  1. Just when the laughter had died down the Shafroth people keep it going. I thought Will Shafroth was far too serious. Now, with this latest hilarious complaint we realize that he may be more Jon Stewart than Mark Udall.

    Has anyone seen the Polis complaint against Shafroth? That should be good for a few laughs too.

    1. People like David keep talking about a complaint against Shafroth…but as far as I can tell it was a phony ploy to divert attention away from Shafroth’s legitimate complaint. Does such a complaint even exist? If not, I would have to assume that there was no merit to the “complaint” in the first place.

      1. The Polis press secretary says a complaint has been filed.

        But, the Polis campaign refuses to provide a copy. Than they have their very own blogger DavidThi say look it up. Than when I try to look it up I find it is not posted on the Polis site or the FEC site. Where can I find a copy of the complaint?

        In my opinion the complaint if it does exist is bogus on its face. They are not distributing copies because they hope this whole fiasco will somehow just go away.

        It is hilarious that a guy who runs as Mr. Ethics is one of the top ten in the country for failing to comply with clear FEC rules. If, his alleged complaint is like his press releases we know it will be so filled with inaccurate statements as to be laughable.

        Who can forget the hilarious press releases that accompanied the trip to Iraq. I used to think that Polis had trouble with the truth. Now I realize that he is just trying to make a joke when he sends out releases with false information.

        A wild and crazy guy that Polis is.

        Can anyone provide a copy of the complaint against Shafroth. Glad to look it up just tell me where it was filed if it was actually filed.

        Now I am not slighting Will either. That e-mail saying that Polis may have stolen their e-mail list is just about the funniest darn thing I have read in a long time.  

          1. Accusing Shafroth of criminal misconduct unless Polis can prove it is just not right.

            I really would like to see a copy of the so-called complaint.

  2. For real… So is Rove style bulls%*@ what we can plan on from Will’s team.

    I think it is funny how little how his team understands how fundraising works.  They lob false complaints and then try to smear jared. It is almost like they work for Fitz-Gerald

    I get mail from all three of them and Udall, Markey ect ect ect ect.  Donors get targeted and you try to raise money from them.

    This is  totally pathetic and a cheap shot from the Will’s Team.

    1. I understand it’s relatively common practice now to keep a few “flag” e-mail accounts on your lists to detect list stealing.  The accounts aren’t published elsewhere, so the only way to get the address is from the list.

      The Shafroth campaign needs to provide some details, though.  There are plenty of things people will take for valid signs of list theft that don’t necessarily indicate list theft (at least not of the campaign’s e-mail list…).

  3. The campaigns probably keep a couple of “flag” accounts around to detect this kind of thing, but the average voter is not, IMHO, terribly likely to be on one of the candidates’ lists but not on the others.

  4. Wasn’t Shafroth’s main complaint that Polis wasn’t disclosing where he was spending his money or who the money was coming from? Not just that he didn’t fill out the form correctly?

  5. a long time ago, that JFG had MA and that gave JFG a real edge in that Mary Alice is a street fighter that knows how to win.  I also said that Shafroth’s secret weapon was Lynea – she doesn’t have the ‘cache’ of MA or Wadman, but she too knows how to win.

    Polis is outgunned in this arena, and Lynea is proving that.

  6. I agree with Lover of Irony.  This is the funniest thing I have ever seen. Charging Polis with stealing Will’s email list? What does Will think, that Jared broke into his campaign office? Every time I think I have heard Will redefine cheap political potshots, he manages to outdue himself. He is making himself irrelevent faster than Jared or Joan ever could do.

      1. Will has turned out to be the funniest guy around. Problem is people are laughing at him not with him.  

        Polis is not far behind. Who can forget his press release bragging about not taking lobbyist money five days after sending out another release bragging about the lobbyists who were supporting him.

        Than for them to accuse each other of the very same thing that they were doing on the campaign filings. Hilarious. Who makes this stuff up?

        The edge has to go to Will though. Bringing out the tired claim of someone stealing an e-mail list. Who will they steal jokes from next?

        Everyone is now waiting to see what the Polis complaint against Shafroth says. I bet that will have a few laughs in it too.

  7. I never thought that Will Shafroth would be the Bob Hope of the Second Congressional District. One joke after the other.

    Jared Polis not to be outdone with his rapid fire run of jokes still has not produced a copy of the complaint he was going to make against Shafroth.

    Everybody except those in the Polis and Shafroth campaigns are laughing away. In a time of turmoil it is great to see two campaigns so dedicated to makiing everyone laugh.

        1. It’s funny because most jokes are. “Please feel free to call me on my cell phone with any questions (303)579-8794 and ask me when I will accuse Polis of planting bugs in our office.”

        It is too funny. If, they actually thought lists were stolen they would have called the FBI not issued a press release. They are just amusing everyone with these laugh filled statements.

        Jared will of course respond with more jokes. Where is his complaint against Shafroth?  

        Violations of the law are serious. What these guys are doing is not claiming laws are broken they are just sending out press releases hoping that someone will believe one of these practical jokes.

          The Shafroth campaign has been told by supporters that they are being contacted by the Polis campaign by unsolicited email.  

          The campaign is looking in to it.

  8. The Shafroth campaign did what many campaigns do and created a private internal email and placed it in our email database for just this reason. This email account has now received two unsolicited emails from the Polis campaign. We have also had more than a dozen personal friends of Will contacting us wondering why their personal information was being made public as they are now receiving Polis campaign emails.

    In response to our supporters’ frustration we sent an email advising them that the Polis campaign may have obtained our information and the way to deal with their frustration was to contact the Polis campaign and ask them how they got their email address. The Polis campaign should be able to explain how they got these email addresses.

    Here are a few of the comments we have been receiving from our supporters:

    – I have been getting unsolicited emails from Jared Polis and I thought immediately that they had somehow confiscated your donor/email list.  I don’t even read them, but just delete them.

    – Interesting…I was wondering where that Roan Plateau email came from…

    – Any idea how I got on the e-mail distribution list of one of your competitors?  I received this e-mail today.  I don’t live in the district and am on your list because Will is a classmate from the Kennedy School.  

    – I don’t know how Jared Polis got my name and email.  You are the only candidate in Colorado that I’ve ever donated to.  I thought you’d like to see this —- but hopefully you are already aware of it.

      You should go into pit bull politics Lynea, It is really your style. This is all smoke and mirrors to get your name into the press.

    2. Recently our campaign received complaints from a few of our supporters claiming they were receiving unsolicited e-mails from another congressional race in the area. In order to address these concerns, we made a call to this congressional campaign and discussed it with them in a professional manner. I suppose it could have been a press hit, but we put integrity and respect above a cheap and easy shot. We came to find out that they were not at fault.

      We are certainly not aware of any list thefts and would welcome the opportunity to help Lynea with her investigation. We share the belief that e-mail addresses and other personal information should remain protected and we will continue to ensure our supporters that their information is safe.

      1. A couple of weeks ago you said that your campaign would be filing a criminal complaint against Shafroth. While you are helping investigate this e-mail issue could you post a copy of the Polis complaint or tell us when a complaint will be filed?

         

        1. Yes, Lover of Irony, we have filed the complaint against Shafroth.

          And no, Stan the Man, I would never have chosen a handle having anything to do with David Hasselhoff.

      2. Press hit?!? From what the Shafroth campaign is saying, these were personal emails to Will’s supporters. It was YOUR supporter who made a news story about it by posting it on the front page here.

        1. Do you think our David has a media bias for us?  David is posting the stories coming out of CD2 – Even if they are not worth anything and Shafroth just stirs the pot with Rove style attacks on fellow Dems.

            BTW, my point was this wouldn’t even be a story if your supporter hadn’t made it one. He isn’t posting the stories coming out of CD-2…he MADE the story.  

              1. If you notice, I have a good sized history on here talking about a number of issues that are not in the district. I think I have build up a good list of posts on here to be able to post on all of these issues.

                Stan, you sound like a Shafroth Staff… maybe you should watching out for Ninja’s.

          To return to reality, I just post what I think are the newsworthy items coming out of the campaigns. It’s up to you guys to decide if they are newsworthy based on the comments.

          And unlike you, I try to take an even-handed view of things. It’s called keeping an open mind.

I think it was appropriate to post.   I thought about posting it myself, but since the campaign hadn’t put out a press release I decided against it.  I figured the campaign was still collecting information after getting tagged on a couple of their plant emails, so I held off.  I certainly understand why you posted it.  However, even though you are generally balanced, you are a Polis supporter even if you take a generally even handed.

          2. I’m not saying you shouldn’t have posted it. What I’m saying is that the Polis folks make it sound like Shafroth put out a press release. They didn’t. You posted it.

      Right, when I get spam mail I immediately assume it was stolen from a specific candidates list. Come on – this seems totally scripted.

        Caution has to be taken here; there are a lot of ways to wind up on campaign e-mail lists besides directly contacting the campaign.  Becoming a delegate and writing down your e-mail is one…

        But having an internal “flag” account that suddenly starts receiving e-mail is pretty serious.

        And if the other “friends of Will” aren’t on any re-distributable e-mail lists, then any contact by the Polis campaign is likely a violation of the CAN-SPAM act, though possibly an inadvertent violation.  It is quite possible the campaign purchased a mailing list from an unscrupulous vendor.

  9. I continue to be shocked at the stupidity of Shafroth’s campaign. He whines about everything, which makes me wonder if he is actually a spoiled brat. He has the background to support it — really the only guy in this race who was born with a silver spoon in his mouth. And, unlike Polis, inherited and married into his millions. Typical behavior for a guy who has been handed everything he has in life. Too bad his family influence can’t buy him a seat in Congress.

How do you propose the polis camp got hold of this list?  I can’t believe any of these claims until I see some logic behind the complaint.  The only possible channel through which this could occur is a mole in the Shafroth campaign.  Either check your staff, Lynea, or post a reasonable complaint.  

      1. Jared Polis went into Will Shafroth’s home with a chip drive.  Was he wearing a ski mask?  Sounds exciting…wish i was a political ninja.

          The question was “how does it happen?”  I explained how I’ve seen it happen.

          I am not saying it happened, but given what Lynea posted, including emails from out of state supporters,  I think it is relatively likely that something happened and I am curious what.

          1. Then i still insist Shafroth broke into his opponents offices and stole their plans.  I’ve seen it happen before (mostly in the movies), and have evidence that it very well could have happened.  So there!

            I only ask because everything Polis does is funny. Who can forget his claim that he had always opposed vouchers. Some thought he was not telling the truth when he was just making a joke. Or his email saying how well he had done on caucus night. That Polis is such a kidder.

        Last time I looked Polis has raised money money than Will or Joan. I do not think he has volunteers going 007 in Will’s office.

          Actually Polis has only “raised the most money” if you include his own money and the money from his family.  He has almost no cash on hand.  Why are you trying to confuse the issue?

              You didn’t address the cash on hand, but that’s fine. That was an off topic point you were trying to make.

              I am no Ninja, but campaigns are always trying to figure out what other campaigns are doing and I have seen campaigns step over the line.  To say otherwise requires a suspension of reason.

            2. Danny is certainly onto something. It is totally believable that Jared or some of his special agents snuck into Will’s campaign and placed a special chip into their system. I mean Will’s fundraising is in third place, so this is totally logical. Your insight should land you a gig with Lynea in no time.

                1. They’re letting volunteers they don’t know use computers with sensitive information and lists on them???? Last time I worked on a campaign, I kept all my lists on a zip drive hung on a string around my neck.  If they’re putting unknown volunteers on campaign staff computers, perhaps their lists deserve to be stolen.

                    Since you maintained such tight data security, you know exactly what a risk it is.  So all of you wacky comments about me have to placed in that context.

                    As to why Shafroth’s campaign might have had lax data security.

                    Maybe Shafroth just assumed that other democratic candidates wouldn’t steal data?

                    Probably was a naive view given that the data seems to be misappropriated.

                    As to do they deserve it.  Maybe.  But if someone stole it do they deserve to be elected: certainly not.

Well…let’s see why i was concerned about security.  Perhaps it was because it was for a presidential campaign that had 150+ volunteers circulating through the office throughout the day every day.  Does Shafroth receive that kind of action?  My guess is no.  It’s a completely different story when you have a base of over 4,000 active volunteers in one city.  I can’t believe you have drinken enough koolaid to really believe this.  These comments from you make your opinion completely moot.

  11. Will Shafroth broke into Polis and Fitz Gerald HQ’s and stole all of their policy ideas.  Can I prove it?  No.  But based on his relentless concurrence with both of his opponents, I can confidently assert he did it.  How?  With a ski mask and crow bar of course.

So now the two campaigns are going to go on the road together with their jokes.How funny that Polis offers to help Shafroth investigate this amazing, strange and odd mystery.  Out of thousands of e-mail messages sent out three are received by people who can’t figure out where they came from.  They should call in the FEC, FBI,  FCC,  FDA, FEMA  FDIC  the FAA to investigate and get to the bottom of this thoroughly baffling problem.

    While Polis is helping Shafroth investigate maybe he can photocopy the criminal complaint he said he would make against Shafroth  and send it to the press. It is so funny that the Polis campaign stops posting when tough questions get asked. When it comes to making a good joke though  Polis and Shafroth are two of the wildest and craziest guys this state has seen in a long time.  

  13. But as an impartial observer, let me suggest that each candidate should devote as much effort to convincing us why exactly it is that they are the BEST candidate for the seat as they do to trying to convince us that the other guy is the worst.

    I know that such a suggestion is borderline heresy in this day and age; that it flies in the face of contemporary politics, but still, it would be refreshing.

    I don’t vote in that district.  However, if I did, I’d want to hear some message that has more to do with “hey, look at me, I’m worth a shit,” and less to do with “the other guy sucks.”

    I don’t think I’m all that different from most people.

  14. It’s amazing the number of truly unreasonable responses this has generated.

    Danny isn’t a conspiracy whacko nor a ninja for his suggestion.  Most data theft occurs from people working for you – people you think you know and trust.  There is little cloak-and-dagger, nor much need for mad ninja skillz.  Campaigns are particularly bad that way – they have limited resources and fill their gaps with volunteers who step up to say “we want to see you elected!”  Volunteers may wind up filling space in what you might think would be “secure” areas, or on tasks that can give them access to data to which they don’t necessarily need access.

    Neither is it difficult to believe that an out-of-state supporter or friend wound up on some other mailing list that Polis purchased.  Were they involved in an effort like Save Roan Plateau, or did they attend a local party event with a sign-in sheet?  Or maybe their e-mail address was stolen by one of the hundreds of thousands of computers compromised by “botnet” softare; spammers get extra money “re-“selling their e-mail lists, and the end purchaser may not realize the origin of some of their contacts.

    Lynea has come here to post that yes, one of their internal watchdog accounts has received these e-mails.  That’s serious.  You don’t just guess at e-mail addresses and send to them; if a watchdog account winds up on a competitor’s e-mail list, you can be pretty sure your list escaped somehow.  Whether it was inadvertent or malicious, deliberately leaked, stolen or just data seepage, it’s a pretty reliable indicator of something.

    PS – David, your catch about the FTC link being for the DoD is a laugh.

    1. If Will Shafroth really thought someone had stolen his e-mail lists he’d have gone to the FBI. If he has proof that someone stole his e-mail list than let’s see it.

      Of course a campaign that will claim not to have taken lobbyist money when they had, said they had supported vouchers when they were major supporters of vouchers, that cannot fill out an FEC form properly and brags about a dismal second place finish at the Assemblies is capable of just about anything.

  15. Yet, there is not one word in 73 posts that indicates a meaningful distinction between the 3 candidates for this Congressional seat.

    That they all have campaign organizations that worry over this $#!+ is not a reason to care.

    1. Out of 75 comments, 24 were by StanTheManSockPuppet and Lover of IronyHis Own Voice. When 33% of the comments are variations on the same though, and another 20 – 30% are people responding to these two yo-yos, then the signal to noise ratio is going to suck.

      1. What in the world? Can’t even do that criticism fairly eh? Coloradobaywatch had 10 posts and I had 12. But of course CBW is a Polis supporter so let’s not criticize them. Polis and his supporters can do no wrong.

          1. I don’t pretend to be something I’m not. I’m actually pretty transparent. David still clings to the illusion that he is fair. He isn’t and to be honest his attempt to fool people makes me more upset than any of the obvious shills on here. It is like the Fox News “fair and balanced” bull. That pisses me off far more than Rush Limbaugh who is an obvious hack and admits it.

              Do I spin everything to his favor and not bring up opposing viewpoints? No. If I did I would never have written this diary as it does not help him. (The one candidate it helps is Joan.)

                Everything you write regarding this race is dripping in language and talking points from the Polis campaign and is spun in their favor. Even when you talk about something stupid or potentially illegal they did (and you can’t avoid it because someone else would bring it up) you characterize it as a tit for tat rather than a serious allegation. You leave out facts that might damage Jared while including them for the other two candidates. You are just as much of a shill as anyone else on here…only you pretend to be fair.

                Anyway David, you seem to have no problem dishing out this kind of criticism about others on your website. You certainly shouldn’t have any problem taking it. Unless, of course, you are like the candidate you support and truly believe you can do no wrong.
